1. About these terms
Passenger Mode is operated by Sean Allen Michael Brown, trading as Passenger Mode (“Passenger Mode”, “we”, “us” or “our”), at 45 Raley Road, SO31 6PA, United Kingdom.
These terms form a contract between us and the person who creates or uses a Passenger Mode account. By creating an account or using the service, you agree to these terms. If you are under 18, please read them with a parent, guardian or another trusted adult if anything is unclear.
2. What Passenger Mode provides
Passenger Mode is an educational observation and reflection tool for UK learner drivers. Learners can work through road-observation prompts, compare what they actually saw with safer driving principles, track progress and revisit topics. Instructors can invite learners, set focus topics and review limited practice information between lessons.
The prompts describe general road-safety principles. Real situations vary, and users must consider the full circumstances. Passenger Mode does not provide legal advice, certify driving ability, guarantee a driving-test result or replace advice from a qualified instructor.
3. Safety rules
- Do not view, hold or interact with Passenger Mode while driving or controlling a vehicle.
- Use the app only as a passenger and only when doing so will not distract the driver.
- Do not encourage unsafe driving to create a practice situation.
- Follow road signs, the law, the Highway Code and directions from police or other authorised persons.
If app content appears inconsistent with the law, an official instruction or a qualified instructor’s situation-specific advice, stop relying on the app and contact support@passengermode.co.uk.
4. Accounts and learner links
You must provide accurate account information, keep your password confidential and tell us promptly if you believe the account is being misused. You must not share an account or use another person’s account.
Learner invitation codes are temporary, single-use and intended only for the learner selected by the instructor. Instructors must keep learner notes brief, relevant and professional and must not enter unnecessary sensitive information.
A learner linked to an instructor receives covered access only while the relationship is active and the instructor has the required access. An instructor may remove a learner when instruction ends. Removing a learner permanently deletes that learner’s Passenger Mode account and associated live practice data.
5. Trials, purchases and subscriptions
Instructor Membership
Instructor Membership is an auto-renewing monthly subscription. In the UK it is intended to be offered at £8.99 per month. An eligible Apple Account may receive the introductory free-trial period shown on the App Store purchase screen. Eligibility is decided by Apple. After any free trial, the subscription automatically renews at the price shown by Apple unless cancelled.
Independent learner access
An independent learner receives a 30-day trial starting when the independent learner account is created. After the trial, permanent independent learner access is intended to be available as a £4.99 one-time purchase. It is not a subscription. Learners covered by an active instructor do not need the independent purchase while that coverage continues.
Apple billing
Digital purchases are made through Apple’s In-App Purchase system and are charged to the Apple Account confirmed at purchase. The exact local price, currency, trial eligibility and billing period displayed by Apple before confirmation govern the transaction if they differ from the indicative UK prices above. Apple processes payment details; Passenger Mode does not receive payment-card information.
Purchases are personal and may not be sold, shared or transferred. Access is also associated with the Passenger Mode account used for the purchase so that it can be verified securely.
6. Cancellation, restoration and refunds
Instructor subscriptions can be managed or cancelled in Apple subscription settings. To avoid renewal, cancel at least 24 hours before the end of the current subscription period. Cancellation normally takes effect at the end of the period already paid for.
The app provides a Restore Purchase control. Restoration requires the Apple Account that made the purchase and the relevant Passenger Mode account. If restoration fails, contact support before deleting or recreating an account.
Deleting a Passenger Mode account does not cancel an Apple subscription and does not automatically create a refund. Instructors who do not want a subscription to renew should cancel it through Apple before deleting their Passenger Mode account. Account deletion permanently removes Passenger Mode account data and access records; a previous purchase may not be recoverable to a newly created Passenger Mode account.
Refund requests for Apple purchases are handled by Apple under its policies and applicable law. Nothing in these terms limits rights that UK consumer law gives you and that cannot lawfully be excluded.
7. Acceptable use
You must not misuse Passenger Mode, attempt unauthorised access, interfere with security controls, submit malicious material, scrape or copy the service at scale, reverse engineer it except where the law expressly permits, impersonate another person, or use the service to harass or harm anyone.
8. Content and intellectual property
Passenger Mode’s original software, interface, branding, question presentation and original explanatory text are owned by Sean Allen Michael Brown or used under licence. You receive a personal, limited, revocable and non-transferable right to use the app for its intended purpose.
Some material is based on public-sector information licensed under the Open Government Licence v3.0. Passenger Mode is independent and is not endorsed by the Department for Transport, DVSA or the UK Government. Third-party names and marks remain the property of their owners.
You retain rights in lesson notes or support material you submit. You give us permission to process that material only as needed to provide, secure and support the service.
9. Availability and changes to the service
We work to keep Passenger Mode reliable, but uninterrupted or error-free availability is not guaranteed. We may maintain, secure, fix, improve or change the service. We will not deliberately remove a paid core feature without reasonable notice where notice is practical, subject to urgent security, legal or platform requirements.
10. Our responsibility
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or mandatory consumer rights.
Subject to those protections, Passenger Mode is a supplemental educational tool. We are not responsible for a road user’s decisions, a learner’s test result, or loss caused by using the app while driving, ignoring official rules or relying on a prompt without considering the real situation.
11. Suspending or ending access
You may stop using the service or delete your account in the app. We may suspend or end access where reasonably necessary to protect users or the service, comply with law, respond to serious misuse or enforce these terms. Where practical, we will explain the reason and provide a way to contact support.
12. Changes to these terms
We may update these terms when the service, payment model, law or platform rules change. The current version and its effective date will be published here. We will give reasonable notice of material changes where required and will explain changes affecting young users clearly.
13. Governing law and contact
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you retain any mandatory protections and right to bring proceedings available under the law where you live. We encourage you to contact us first so we can try to resolve a concern.
